Top Ten Myths In Estate Planning
I am so grateful for your support this year. I have had my own law practice for 34 years and I could not have done it without my loyal clients. This year started off terribly, with the pipes at my office bursting during the Christmas freeze. My office building is over 100 years old, so it took a lot to restore my building. I hope your last Christmas was not so disruptive, and I hope your Christmas this year is full of love, fun, family and friends. Here is something to think about as you begin 2024.
TOP TEN LEGAL MYTHS IN ESTATE PLANNING
1. My children know what I want to happen after my death so I do not need a will.
2. If I have a will my estate will not go through probate.
3. If you are married, you don’t need a will because your spouse will inherit everything.
4. It is best to name all my children as personal representatives in my will and as agents in my power of attorney so that none of them feel left out.
5. I do not need an attorney to help me write my will, it is a simple document and there are lots of forms online.
6. Signing a quitclaim deed adding my children on the title to my house is a good idea.
7. Placing my children’s names on my bank accounts is the best way to transfer my bank accounts at my death and give my children access if something happens.
8. Probate in Colorado is awfully expensive and takes a long time.
9. I do not have anything so I don’t need a will.
10. The agent in my power of attorney oversees my affairs after my death.
